New rules for the import of e-commerce goods from third countries

Today, at the site of the Eurasian Economic Commission (EEC), active work is underway to develop acts aimed at implementing the Protocol on Amendments to the Customs Code of the Eurasian Economic Union of December 25, 2023 regarding the regulation of foreign electronic trade.

Let us recall that on December 25, 2023, the heads of the member states of the Eurasian Economic Union (EAEU) signed amendments to the EAEU Customs Code aimed at comprehensive regulation of the movement of e-commerce goods across the customs border.

In particular, the institution of an e-commerce operator has been introduced, the use of a new type of declaration for customs declarations (declaration for e-commerce goods), the possibility of selling foreign e-commerce goods to individuals using customs (“bonded”) warehouses, as well as features of the application of customs duties are provided.

To implement these EEC amendments, together with the authorized bodies of the parties, draft EEC decisions are being developed that determine the form and procedure for filling out a declaration for e-commerce goods, the procedure for identifying e-commerce goods, the size of the single rate of customs duty in relation to e-commerce goods, ensuring the fulfillment of the obligations of an e-commerce operator and other.

These documents must be put into effect simultaneously with the entry into force of the Protocol on Amendments to the Customs Code of the EAEU dated December 25, 2023. The Protocol is currently undergoing ratification in the EAEU member states.It is expected to come into force before the end of this year.

The new regulation will help ensure professionalization of activities and convenience for the end consumer. All support functions, including responsibility to customs authorities, will be assumed by a new participant in the supply chain - the e-commerce operator. The Protocol defines the framework of cooperation between him, customs and the buyer. At the same time, the possibility of citizens to register goods independently is not excluded.
